Terms of Sale for the Online Store

The owner of the online store Bloomroom (hereinafter referred to as the “Online Store”) is OÜ Luxara (registration code 16869131), located at Sõrve tee 32, Harku vald.

**Validity of the Sales Contract, Product, and Price Information**

The terms of sale apply to purchases of goods from the Online Store.

The prices of the products sold in the Online Store are indicated next to the products. The price is subject to a delivery fee and tax. All prices of goods sold in the Online Store are in euros.

The delivery fee depends on the buyer’s location and the method of delivery. The delivery fee is displayed to the buyer during the order process.

Information about the goods is provided directly alongside the goods in the Online Store.

**Placing an Order**

To order goods, the desired products must be added to the shopping cart. To finalize the order, the required data fields must be filled out, and a suitable method of delivery must be selected. The screen will then display the total cost, which can be paid securely using the following payment methods:

– Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Bank, Citadele, Pocopay.

**Note:** When paying via a bank link, be sure to click the “Return to the merchant” button on the bank’s page.

Payments are mediated by Montonio Finance OÜ. Payments are processed outside the Online Store in a secure environment – payments via bank link are processed in the respective bank’s secure environment, and payments by credit card are processed in Montonio Finance OÜ’s secure environment. The seller does not have access to the buyer’s bank or credit card details. The contract is effective from the moment the amount due is credited to the Online Store’s account.

The Online Store owner is the data controller and will forward the personal data necessary for processing payments to the authorized processor Montonio Finance OÜ.

If the ordered goods cannot be delivered due to their unavailability or for any other reason, the buyer will be informed as soon as possible and the paid money (including delivery costs) will be refunded without delay, but no later than within 14 days of sending the notification.

**Gift Card**

The Bloomroom online store sells gift cards in amounts of 50, 100, 150, and 200 EUR. Gift cards are issued digitally to the email address specified by the buyer within 2 business days.

**Conditions:**

– The gift card is valid as a payment method for the total value of the card.
– The gift card is for one-time use only.
– The gift card is valid for 2 months from the date of issue.
– The gift card is non-refundable and cannot be exchanged for cash.
– Shipping costs cannot be paid with the gift card.

**Delivery**

Goods are shipped within Estonia.

Goods are delivered via parcel machines. The Online Store’s delivery partners are Itella Estonia OÜ.

The cost of shipping is borne by the buyer and the relevant pricing information is displayed next to the shipping method.

Domestic shipments generally reach the buyer’s designated destination within 14 days from the conclusion of the sales contract.

In exceptional cases, the right is reserved to deliver the goods within up to 30 calendar days.

**Order Cancellation Before Fulfillment by the Online Store**

To cancel an order, you must immediately write to the email address itsbloomroom@gmail.com, as the ordered posters are sent to print within 1 day after the order is placed. The email must include the order number, date, and the buyer’s contact information.

If the cancellation notice reaches the Online Store after the order has been fulfilled, the terms stated under “Right of Withdrawal” will apply.

The Online Store will refund the buyer without delay, but no later than within 14 days from the receipt of the cancellation notice, all payments received from the buyer under the contract. Refunds will be made to the same account from which the payment for the order was made.

**Right of Withdrawal**

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.

**Returns**

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of withdrawal, the ordered goods must not be used in any way other than necessary to ascertain the nature, characteristics, and functioning of the goods in the same way as it would be allowed in a physical store.

By purchasing goods from Bloomroom, the buyer agrees that no refunds will be issued. Only exchanges for a different color of the same product are allowed, subject to availability and provided the request is made within 14 days of receiving the product.

To return the goods, a free-form declaration must be submitted, including the buyer’s name, a description of the purchased goods (product name), and proof of the transaction. This declaration must be sent to the email address itsbloomroom@gmail.com no later than 14 days after receiving the goods.

The costs of returning the goods are borne by the buyer, except in cases where the reason for the return is that the product does not match the order (e.g., wrong or defective product).

The buyer must return the goods within 14 days after submitting the return declaration or provide proof that the goods have been handed over to the carrier within the aforementioned period.

Upon receiving the returned goods, the Online Store will refund the buyer without delay, but no later than 14 days after receiving the withdrawal declaration, all payments received from the buyer under the contract.

The Online Store may withhold the refund until the goods are returned or until the buyer has provided proof of returning the goods, whichever occurs first.

If the buyer has explicitly chosen a delivery method different from the cheapest standard delivery method offered by the Online Store, the Online Store is not obliged to refund the additional cost exceeding the standard delivery cost.

The Online Store has the right to withdraw from the sales contract and demand the return of the goods from the buyer if the price of the goods in the Online Store was mistakenly listed significantly below the market value.

**Right to File a Claim**

The Online Store is responsible for any non-conformity or defect of the goods sold to the buyer that existed at the time of delivery and which becomes apparent within six months of the delivery of the goods to the buyer. Within one month of the delivery of the goods to the buyer, it is presumed that the defect was present at the time of delivery. It is the responsibility of the Online Store to refute this presumption.

The buyer has the right to file a claim with the Online Store within two months of discovering the defect by sending an email to itsbloomroom@gmail.com.

The Online Store is not responsible for defects that occur after the goods have been delivered to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all payments received under the sales contract.

The Online Store will respond to the buyer’s complaint in writing or in a form that can be reproduced in writing within 15 days.

**Direct Marketing and Processing of Personal Data**

The Online Store uses the personal data provided by the buyer only for processing orders and delivering goods to the buyer. The Online Store transmits personal data to companies providing delivery services to fulfill the delivery of goods.

The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to receive such communications by entering their email address on the website and indicating their desire to receive direct marketing messages.

The buyer can unsubscribe from newsletters and offers at any time by notifying us via email or by following the instructions provided in the email containing the offer.

**Dispute Resolution**

If the buyer has any complaints regarding the Online Store, they must be sent via email to itsbloomroom@gmail.com.

If the buyer and the Online Store cannot resolve the dispute by mutual agreement, the buyer has the right to contact the Consumer Disputes Committee. The terms of the procedure can be found and a complaint can be submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from contracts between the buyer and the Online Store. The examination of the buyer’s complaint by the committee is free of charge.

The buyer can also turn to the European Union’s Online Dispute Resolution platform.
